1. Scope and provider

These terms apply to the conversation-class membership and the private lessons package on simmonds.online. The provider is Simmonds Language Services, owner: James Simmonds, Schaufelder Str. 11, 30167 Hannover, Germany (see the legal notice).

2. What the membership includes

Live online conversation classes of 60 minutes in groups of up to 10 people at one level, led by a native-speaking teacher. You book the classes you want from the calendar. An AI practice partner may be offered between classes; it supports your practice and never replaces the teacher.

3. Contract

You need an account. The contract is made when you complete the payment in the checkout.

4. Price and payment

The membership costs €30 a month. Your first month costs €10 as an introductory price. Payment is made monthly in advance through Stripe. Our teaching services are exempt from VAT under § 4 No. 21 UStG, so no VAT is added.

5. Term, cancellation and pause

The membership runs month by month and renews automatically. You can cancel at any time with effect from the end of the month you have paid for, in your account or the customer portal. You can pause the membership for up to two months; no fee is charged during a pause.

6. Booking and cancelling classes

You can book a seat in any class at your level while seats are free. You can cancel a booking up to 60 minutes before the start. The room opens 10 minutes before the start. Classes you miss without cancelling are not refunded or carried over.

7. Right of withdrawal for consumers

If you are a consumer you can withdraw from the contract within 14 days without giving reasons. If you ask us to start the classes during the withdrawal period, you pay a proportionate amount for the classes provided until you withdraw.

8. Private lessons package

The private lessons package is 6 hours of one-to-one online lessons with a native-speaking teacher from the Simmonds team for a one-off €600. The package is exempt from VAT under § 4 No. 21 UStG.

The 6 hours are valid for 3 months from the date of payment. Hours not taken within these 3 months expire without refund.

You have no right to a particular teacher, including James Simmonds. Your lessons may be given by another qualified native-speaking teacher from our team, for example when a teacher is ill or unavailable. The price and the number of hours stay the same.

You choose the time of your first lesson in the calendar on simmonds.online and pay by card through Stripe. The contract is made when the payment is complete. We arrange the remaining hours with you by e-mail.

You can cancel or move a lesson free of charge up to 48 hours before it starts, by phone (+49 511 9573 3819) or in writing (e-mail to [email protected]). A lesson cancelled later, or missed, counts as given and is neither refunded nor made up.

When you book, you ask us to start the lessons before the 14-day withdrawal period ends. If you withdraw after lessons have started, you pay for the hours already given. Your right of withdrawal ends once all 6 hours have been given.

9. Conduct and recordings

Classes are not recorded. Please do not record them yourself. We may exclude participants who repeatedly disrupt a class.

10. Liability

We are liable without limit for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for the contract.

11. Final provisions

German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you live remain unaffected.
